Here is an example of the terms & conditions in place when making a wedding photography booking. When a booking is made it is agreed that the terms set out is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

  2. Deposit Payment -  A non-refundable fee of 25% of the wedding package is charged when the client makes their booking, this fee is deducted from the total price. This deposit will secure the time and date agreed, and no other reservations will be booked by the photographer for that date and time.

  3. Full Payment – The remaining balance is due atleast 14 days before the wedding day agreed in the contract. The client agrees if the balance is not paid by this time, the photographer will not photograph the wedding day agreed in the contract, with a loss of the reservation deposit by the client and no liability to the photographer.

  4. Cancellation - The client may cancel this contract at any time by giving written notice, but in doing so shall forfeit any monies paid. In the event of the cancellation less than 12 weeks before the wedding will result in the payment in full.

  5. Venue and Location Limitations - The Client agrees and understands that the Photographer is limited by the guidelines of the ceremony official or reception site/venue management and agrees to accept the results that may occur from said guidelines. Negotiation with the officials for moderation of guidelines is solely the Client’s responsibility.

  6. Limit of Liability - In the unlikely event that the Photographer is injured, becomes too ill, or has an emergency that prevents them from photographing the event, the Photographer will make every effort to secure a replacement photographer. If a suitable replacement is not found, the Client agrees that responsibility and liability of the Photographer to the Client is limited to the return of all payments received for the event. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the Photographer’s control, including but not limited to camera, hard drive, or equipment malfunction, the Photographer’s liability is limited to the return of all payments received for the Wedding Package.

  7. Force Majeure – No party shall be liable or responsible for any failure or delay in fulfilling any term of this agreement when caused by or results from acts beyond the party’s control, including, but not limited to, the following force majeure events (“Force Majeure Events”): (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), epidemic, or pandemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. The Impacted Party shall give Notice within 30 days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party’s failure or delay remains uncured for a period of 14 days following Notice given by it, the other party may thereafter terminate this Agreement upon Notice.

  8. Cooperation – The Client will be responsible for, or have someone designated, to identify people of whom specific photographs are desired. The photographer will not be held accountable for not photographing desired guests if there is no one to assist in identifying and gathering people for photographs. The Photographer is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to the Photographer or beyond the Photographer’s control.

  9. Retouching - All images will be adjusted for exposure, brightness, contrast, sharpness, etc The Photographer's judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct.

  10. Completion Schedule - The Client agrees that no photographs, digital or prints, will be delivered until the Outstanding Balance is paid in full. Digital processing takes up to two months. Photographs will be provided to the Client on a USB/CD no more than 1 month after the personalisation details have been agreed.

  11. Digital Negatives, Prints and Copyright - The photographs, digital negatives or prints produced by the Photographer, are protected by International Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos and images produced. The Client will receive a copy of the digital photographs on an online album and USB, as part of the Wedding Package. The Client may reproduce any images in any manner they like for sharing and enjoyment of friends and relatives. However, the Client must not reproduce any images for publishing or selling for profit. 

  12. Delivery – The client will receive their photographs in two forms. Lower resolution (web quality) images will be provided via a private, password protected online gallery, and High resolution (printing quality) images will be provided on USB. The client is able to order printed products via their online gallery, which will be printed to the highest quality.

  13. Display - The client has the right to choose whether the photographer displays their photographs, through the website, online sharing, advertising and print material. The client can fill out a separate form the declare their stance on this.

  14. Travel - All travel expenses are based on the distance between the event location(s) and the business address (Hinckley, Leicestershire).  For all events, the first 30 minutes of travel is included, however if travel time exceeds this an additional cost will be added by the Photographer.
