Terms & Conditions
1. Parties
1.1. This contract is between Grace Bennett of Grace Nicole Photography, 23 Highgrove Close, Burbage, Leicestershire, LE10 3JQ (Referred to as “I"/"Me"/"My"/"Grace”/) and Client (Referred to as “You”/"Your"/"Client")
1.2. The "Client" is the couple whose wedding this contract relates to, regardless of who's paying.
1.3. This contract is governed exclusively by the laws of England and Wales.
1.4. Below are the terms and conditions on which Grace shall provide photography services (the “Photography Services”) to You. The exact Photography Services provided will depend on what is agreed between the parties during an initial consultation (see below Clause 1).
1.5. It is mutually agreed that the following terms of agreement form an integral part of this agreement and that no variation or modification of this agreement shall be effective unless accepted by both Grace and You, in writing and signed by the parties.
2. Booking & Payment Arrangements
2.1. To book Grace for your wedding, there is a booking fee which is due at the time of booking along with a completed booking questionnaire and a signed copy of this contract. The booking fee is 25% of your package, additional services and products chosen when booking.
2.2. The booking fee is 25% of your package, additional services and products chosen when booking, shown above in the 'Service & Price Information' section of this contract. This booking fee is non-refundable. Payment of the booking fee will retain Grace's services for the date of your wedding and ensures I turn down other enquiries for that date. It also covers all the work undertaken in the lead up to your wedding such as (but not limited to) admin, meetings and written communications.
2.3. There is a 14 day money-back policy if you change your mind. This starts on the day we receive your booking form, signed contract and booking fee.
2.5. The remaining balance will be due 14 days before your wedding.
2.6. The client agrees if the balance is not received by the due date, the photographer reserves the right to cancel the booking without prejudice to any claims which may have arisen and retains all monies paid.
3. Wedding Day Logistics
3.1. To make sure everything runs smoothly in the lead up to your wedding and on the day itself, you'll need to tell Grace (in writing) about any changes to the details on your booking form, such as contact information, venue location and ceremony time, as soon as you are aware of the change. 
3.2. I can't guarantee that I will be able to accommodate fundamental changes, like a change in date or venue, we will do my best to help in any way I can.
3.3. Some venues may place restrictions on photography. Before your wedding you will need to organise any necessary permission , licenses, permits and access arrangements which your ceremony and reception venue(s) may require.
4. Services Provided
4.1. The service you have booked is outlined above in the 'Service & Price Information' section of this contract. Please check the content carefully to make sure it's what you're expecting.
4.2. You can upgrade or add to the service at any time but please be aware that extra hours and additional photographers are subject to availability
4.3. Payment for any additional services or expenses will be due 14 days before your wedding.
4.4. If events over run by more than 30 minutes from the scheduled finish time, Grace reserves the right to end her services at the agreed time. If you would like extra coverage in the case of over running this must be agreed in writing prior to the wedding, and will incur additional costs. Any extra expenses are due within 7 days of demand.
4.5. The price of any extra items, albums or upgrades will be the price that's current when your order them. This might be different from the price they were when you booked.
4.6. I continually improve my product ranges which means that products are discontinued from time to time and often without notice. This might mean, for example, that a specific make or size of album won't be available, particularly if you book us well ahead of your wedding. If this happens, I will replace the discontinued item with a product of similar value and quality.
5. Turnaround Times
5.1. Photography post production takes up to 8 weeks.
5.2. Your digital photographs will be delivered first online, the will be uploaded to a private online gallery in which a link will be emailed to you as soon as the site is live.
5.3. Your digital photographs will also be delivered on a USB stick, which will be posted via Royal Mail First Class. You will need to confirm your USB design choices in writing before it will be made.
5.4. If you have booked an album:

5.4.1. Please start choosing which photographs you would like in your album two weeks after you receive your online gallery and notify us when this is done.

5.4.2. Please confirm your cover design in writing via email.

5.4.3. I will then start creating a first draft of your album which you’ll receive within 10 working days from receiving your choices. I will then ask if you would like any amendments.

5.4.4. A second draft with your chosen amendments will be sent to you within 10 working days. I will then ask if you would like to make any further amendments.

5.4.5. A third and final draft will then be sent to you within 5 working days for you to confirm you are happy with the final design. If you would like to make any further amendments this can be done as an additional cost of £25 per draft.

5.4.6. You are able to add additional pages, alter your cover design or swap to a different style of album at any stage of the design process, however this is subject to product specifications, availability and may incur additional costs.

5.4.6. If your album design is not signed off within six months of your wedding day any cost increase from our suppliers will be passed on to you. You will be kept fully informed of all progress and any changes to price should this occur.

5.4.7. Your album will be made and posted to you within 3 weeks of confirming your final draft.
6. Creative License
6.1. Grace shall be granted creative and artistic licence in relation to the Photographs including without limitation, their selection, editing and post processing. Lisa’s judgement on photographic style shall be deemed correct. Due to the weather and the availability of subjects, no one image is guaranteed.
6.2. Most of your wedding photos will be captured in a ‘reportage’ style. The nature of this style is to capture moments as they happen, without intervention. While I will always ask for any special requests or group photos, I do not work to a set list of specific images for the full day.
6.3. Please look through my portfolio and sample albums carefully before you book to make sure that you like my style of work. You won’t be able to reject the photos if you’re unhappy with the style in which they’ve been taken and/or edited.
6.4. Your photographer(s) will have the final choice over how, where and how many photos are taken. I will collaborate with you as much as we can to ensure you are happy with the result.
6.54. There are sometimes things outside of our control (like the weather, delays to timings or guests being unavailable) that can affect our ability to get the photos that you’ve requested. But I will work closely with you to try to make it all happen and keep you informed of any problems.
6.6. I'm all about quality, so all the photos I take will be carefully evaluated and edited to their best standard as high resolution JPEG files. You’ll only receive the images that meet my quality standards. Everything else will be discarded. For example, duplicates and test shots or anything I consider un-deliverable will be deleted. RAW files cannot be delivered.
7. Exclusivity

7.1. I must be the only professional stills photographer that you commission, paid or not, to take photos at any of the locations used for your pre-wedding shoot and wedding.
7.2. You should help ensure that other suppliers or guests do not compromise or interfere with my work during your wedding day.
8. Copyright & Use of Photographs
8.1. The 1988 Copyright, Designs and Patents Act assigns copyright of all images to Grace Bennett, of Grace Nicole Photography. I retain the entire copyright in the photos taken, at all times, throughout the world.
8.2. You will not receive or be able to use the photographs until any relevant payments have been made in full, unless we’ve given you express written permission.
8.3. Any permission to use the photos will be automatically revoked if full payment isn’t received by the due date.
8.4. You’ll have a non-exclusive right to use the digital format of the photographs for your own private purposes, which includes making copies, printing, sharing with family and uploading to any social media channel.
8.5. The licence to use the photographs is personal to you and can’t be assigned to any third party without our prior written consent. This means, for example, that if any supplier associated with your wedding (florist, cake-maker, venue, etc) asks to use photos from your wedding please put them in touch with me and I will organise it. It also means you can’t sell them in any way or submit them to a wedding magazine or blog without my consent.
8.6. The licence doesn’t cover manipulation or modification of the photos in any way, by any person or company outside of Grace Nicole Photography. Nor does it extend to use of only part of a photo without our prior written consent.
9. Storage & Security of Digital Files
9.1. I will do everything I reasonably can to ensure the safe-keeping of your photos. All images are backed up immediately after shooting your wedding onto multiple hard drives and password protected computers.
9.2. In the highly unlikely event of any photos being lost or destroyed before you’ve received everything you’ve booked, Grace's liability will be limited to the money that you’ve paid up to that point.
9.3. Once you’ve received your photos I will keep backup copies for at least one year. Please ensure you backup your USB in several places to keep your photos safe.
9.4. Your online gallery will be live for 1 year and 1 month from your wedding date. After this date all photographs will be taken offline.
10. Back-Up Plans
10.1. If something outside of our control (like death, illness, family crisis) prevents delivery of any part of our service, then every effort will be made to find another professional photographer with a similar style to help. If I can’t find someone to cover, my liability will be limited to a refund of the money you’ve paid.
10.2. I always have back-up equipment with me so if something breaks I can usually carry on. It’s highly unlikely, but if my camera equipment should fail completely, my liability will be limited to a refund of the money you’ve paid.
11. Cancellation
11.1. It’s a rare occurrence but if I have to cancel this contract for reasons outside my control (like death, injury or sickness), my liability is limited to a refund of the money you’ve paid. But I will do everything possible to help you find another photographer.
11.2. If you cancel completely:

within the first 14 days of booking - your booking fee will be refunded.

91 days or more before your wedding - 50% of your total fee remains due
-
61-90 days before your wedding - 75% of your total fee remains due
-
60 days or less before the wedding - 100% of your total fee remains due
If I am able to secure another wedding booking for your cancelled date, I will refund the difference between the booking fee and the money you’ve paid (the booking fee covers the time and expenses I incur before your wedding.)
11.3. If you cancel because you’re postponing your wedding:

11.3.1. Your booking and money paid can be transferred to your new date if I am available.

11.3.2. The total fee due will be the current fees that apply for your new wedding date.

11.3.3. If I am not available for your new wedding date your booking fee will be retained unless another wedding can be secured for your initial date.
11.4. All cancellations must be made in writing or via email.
12. Privacy
12.1. I will keep your name, contact details and information about your wedding on my private internal database program provided by studioninja.co. I won’t give your details to anyone else without your prior permission.
13.2. All of my online galleries are provided by pic-time.com. In order to access your gallery and download images you will need to log in with your email address and password. If you choose to share this gallery with guests, friends or wedding suppliers please be aware that Grace Nicole Photography holds no responsibility for how they choose to use the photographs. Please make your guests aware of your privacy preferences.
13.3. The client has the right to give consent on how their photographs are used by Grace Nicole Photography. If the client opts out, Grace Nicole Photography reserves the right to display images which do not depict identifiable persons and details, e.g. photographs of the venue, non-personalised details, silhouettes, etc.
